中文摘要: 上海蓝天公司是一家由天一闽等几位动漫爱好者一起创办的内资企业。2008年8月天一闽招聘了新加坡人Shirley,并向Shirley签发聘用通知书。聘用通知书规定:任何一方可以提前三个月以通知的方式解除合同;当时如果Shirley泄露了公司的技术信息、商业秘密等,公司可以立即解聘。之后,公司为Shirley办妥了在上海的就业许可手续。但是双方的关系在2011年破裂,于是2011年11月,公司书面通知Shirley将于三个月后,即2012年1月,解除双方的聘用关系。2011年12月,公司发现Shirley有私下录入公司客户信息的行为,以侵犯了公司的商业秘密为由,立即解聘了Shirley。Shirley对公司的解聘决定持有异议,以非法解除劳动合同为由,向上海的劳动人事争议仲裁部门提出仲裁申请。
英文摘要: Leading by the manager Yimin Tian and after overcoming many difficulties, Shanghai Nan Tian Company, a Chinese domestic cartoon company has achieved a great development in its target field. In August 2008, Tian hired his former Singaporean teacher Shirley as “program manager” of the company and signed a labor contract with her. The contract covers the company name, contract duration, workplace, salary information, annual leaves with pay, contract termination, commercial secret and some other basic items. Soon after concluding the contract, the company helped Shirley applied for a working permit according to Chinese law. However, the good relationship between Shirley and the company was broken up in 2011. In November 2011, the company told Shirley that it would terminate the employment contract in 3 months (January 2012) with a written notice. And in December 2012, the company found that Shirley had copied some customer information privately, which was considered by the managers to be an infringement to the business secret of the company. Consequently, the company immediately fired Shirley. Therefore, Shirley brought an arbitration against the company in the labor dispute arbitration committee in Shanghai for illegal termination of labor contract.
